In 2014 our client recognised that its local staff were unable to secure entitlements under the contract and that its costs were exceeding what it was going to recover.
Our director visited the project in Peru and agreed a strategy with the client to embed an expat expert team within the project structure to firstly correct processes and procedures and secondly to implement the production of a substantial claims submission supported by robust evidence.
Within a few weeks the team had been able to engage with the mine owner and its adviser and give budgetary cost information and indication of time extension so that when the final submission was made it was expected and provisions had been made for it.
There followed an eleven month process of producing final claims supported by forensic planning, costs, correspondence and production records. Within one month of its receipt an agreement in principle had been reached between our client and the mine that additional cost would be paid.
