Description
The subject of the order is the management of municipal waste collected by entities collecting municipal waste for the benefit of the commune of the city of Grudziądz from the owners of properties where the residents and non-residents live, and municipal waste from the area of the commune of the city of Grudziądz is produced, specified in the draft agreement and under the conditions described in the detailed description of the subject of the order (annex to the agreement).The Contractor shall manage the following types of municipal waste:- unsegregated (mixed) municipal waste (code 20 03 01),- biodegradable municipal waste, including kitchen waste and green waste from gardens and parks (code 20 01 08, 20 02 01),- plastics, plastic packaging, metals, metal packaging and multi-material packaging (code 20 01 39, 15 01 02, 20 01 40, 15 01 04, 15 01 05),- glass and glass packaging (code 20 01 02, 15 01 07),- paper and cardboard and paper and cardboard packaging (code 20 01 01, 15 01 01).
The subject of the contract is the management of municipal waste collected by entities collecting municipal waste for the benefit of the municipality of the city of Grudziądz from the owners of the properties on which the residents and non-residents live, and municipal waste from the area of the municipality of the city of Grudziądz is produced, specified in the draft agreement and under the conditions described in the detailed description of the subject of the contract (Annex to the agreement).The Contractor shall manage the following types of municipal waste: unsegregated (mixed) municipal waste (code 200301), biodegradable municipal waste, including kitchen waste and green waste from gardens and parks (code 200108, 200201), plastics, plastic packaging, metals, metal packaging and multi-material packaging (code 200139, 150102, 200140, 150104, 150105), glass and glass packaging (code 200102, 150107), paper and paperboard and paper and paperboard packaging (code 200101, 15010101). The Contractor shall accept municipal waste from the indicated entities and then manage it according to the waste hierarchy referred to in Article 17 of the Waste Act. Estimated amounts of municipal waste to be managed during the term of the agreement from the area of the municipality of Grudziądz - 31 660 Mg. The Contracting Authority requires that the Contractor has an installation ensuring processing of municipal waste with processing capacity capable of managing the estimated quantities of waste during the term of the contract. The Contracting Authority may, within 3 years from the date of awarding the basic contract, award the current Contractor a contract consisting in repeating waste management services for a period of up to 6 months from the date of completion of the basic contract, in particular in the event of failure to resolve the next procedure or exhaustion of funds provided for the performance of the basic contract. The order completion date and price shall be determined by way of negotiations. The award of a contract consisting in the repetition of similar services shall be a unilateral decision by the Awarding Authority at its discretion, subject to budgetary constraints and the absence of any other effective obligation to perform the service covered by the basic contract. The Awarding Entity envisages the possibility of introducing changes to the content of the concluded contract in relation to the content of the tender on the basis of which the Economic Operator was selected, in the following scope:1) participation of the subcontractor (or its change) at the stage of contract performance, if at the request of the Awarding Entity the Economic Operator presents statements or documents confirming that there are no grounds for exclusion against this Economic Operator; 2) changes in the scope of subcontracting; 3) changes in generally applicable provisions of law or resulting from final judgements or final administrative acts of competent authorities - to the extent necessary to adapt the provisions of the contract to the existing legal or factual situation;4) occurrence of force majeure - understood as the occurrence of an extraordinary, external, unforeseeable and unavoidable event, which could not have been avoided even with the utmost care, and which enables the Economic Operator to perform his obligation in whole or in part. In the event of force majeure, the parties to the contract are obliged to make every effort to limit to the minimum the delay in performing their contractual obligations resulting from the force majeure; 5) The Awarding Entity also provides for the possibility to introduce changes to the content of the concluded contract in the circumstances and cases specified in Article 144(1)(2), (3), (4), (5) and (6) of the PPL.
