This is not an open procedure, but a so-called open-house model! The form for the open procedure is only used because there is no form for the open-house model. Contracts that are concluded in the open-house model are not subject to public procurement law due to the lack of a selection decision. The use of this form does not imply submission to public procurement regulations. The AOK Bayern intends to conclude non-exclusive discount agreements with all interested pharmaceutical companies for the active ingredient Lipegfilgrastim, ATC L03AA14, in accordance with § 130a para. 8 SGB V. AOK Bayern offers all interested pharmaceutical companies that fulfill the eligibility requirements listed below the conclusion of identical and non-individually negotiable discount agreements. The earliest possible contract start date is 01.01.2025, all contracts end on 31.12.2026. A contract can be concluded at any time during this term, but no later than 05.11.2026. The contracts can be terminated with one month's notice to the end of the month. If a discount agreement for medicinal products with the active ingredient in question comes into force through a national or state-specific open procedure, the open-house agreements will automatically expire for the corresponding term. A contract is concluded with all interested pharmaceutical companies that prove their suitability by submitting a completed and signed self-declaration of reliability. The pharmaceutical company must submit the completed and signed contract (the authority of the signatory(ies) to represent the company must be evident from the extract from the commercial register, otherwise a power of attorney must be submitted) together with the completed and signed annex "Specification of the medicinal products covered by the contract" and the completed and signed self-declaration of reliability. The documents can be submitted EITHER in WRITTEN form signed by hand OR ELECTRONICALLY with a qualified electronic signature. If complete and correct documents are received by the 5th of each month, the contract will commence on the first day of the following month, otherwise on the first day of the month after next.
