The State of Rhineland-Palatinate, represented by the Head of the Central Procurement Office of the State of Rhineland-Palatinate (ZBL) in the Rhineland-Palatinate State Mobility Office, plans to use this voluntary transparency announcement to announce the operation and expansion of multi-supplier catalogs to simplify the state-wide procurement of supply services for a wide range of product groups and at the same time calls on interested competitors to participate in the multi-supplier catalogs of the State of Rhineland-Palatinate.

With this voluntary transparency announcement, the ZBL intends to publicly invite all interested competitors to participate in the multi-supplier catalogs of the state of Rhineland-Palatinate using the relevant publication platforms.
In doing so, it proceeds analogously to Part 4 of the Act against Restraints of Competition (GWB) in conjunction with the Ordinance on the Award of Public Contracts (VgV) and the applicable statutory provisions, although no award in the classic sense takes place, but only the conditions of participation for the competitors are defined, announced and published. The multi-supplier catalogs are available to all interested competitors for participation for the duration of their operation.
Insofar as reference is made in the procedural documents (Parts A, B, R and all annexes) to legal provisions of public procurement law, these shall apply exclusively accordingly. The provision of the multi-supplier catalogs is not part of a procurement procedure. Public procurement law only applies in the context of the actual awarding of contracts by the user.

The participation documents provided by the ZBL in this voluntary transparency notice regulate the access and participation of interested competitors in the multi-supplier catalogs of the state of Rhineland-Palatinate.

Applicants become economic operators in the multi-supplier catalogs when they are included in and post an online catalog.

After the announcement of transparency on the publication platform for tenders of the EU and the procurement marketplace of the state of Rhineland-Palatinate, the economic operators are given the opportunity to place their products free of charge on the multi-supplier catalogs in operation for retrieval by the users.

The prerequisite for the acquisition of an authorization to participate by the applicants is a suitability test successfully completed by the ZBL in accordance with the participation documents and the absence of grounds for exclusion.

Further procedural details:
By means of this voluntary transparency announcement, an unlimited number of companies (competitors) are publicly invited to participate in the multi-supplier catalogs of the state of Rhineland-Palatinate. Any interested company can submit an application to participate in the multi-supplier catalogs. With the application for participation, the companies submit the information required by the ZBL to check their suitability.
If a company is suitable and there are no grounds for exclusion, the ZBL will ask the company to submit catalogs for one or more of the lots specified in the participation documents. Upon submission of the application for participation, a user agreement for participation in the multi-supplier catalogs of the state of Rhineland-Palatinate is concluded between the ZBL and the suitable economic operator.

On the basis of the posted product catalogs, the public authorities can carry out awards and award procedures up to the thresholds permitted under public procurement law (direct purchases currently up to a maximum of EUR 3,000 net and negotiated procedures currently up to a maximum of EUR 40,000 net), taking into account the budgetary principles of efficiency and economy.
