The subject matter of the contract includes technical support for licensed software OPDR - module for handling textbook subsidies and REKO - module for handling financial aid for training costs of young employees, which are extensions to the Employer's IT system ODPN, data hosting and administration on servers. 1.
The subject matter of the contract includes technical assistance for licensed software OPDR - module for handling textbook subsidies and REKO - module for handling financial aid for training costs of young employees, which constitute an extension to ODPN IT system owned by the Contracting Authority, hosting data and administering on servers.2. The technical assistance referred to above includes:1) ongoing telephone and e-mail support for all users;2) installation of software updates related to changes in local and national legislation, up to 7 days after they come into force;3) removal of software failures that prevent the Ordering Party's work, within the period from the user's notification up to 96 hours falling on working days;4) removal of defects reported by the Ordering Party within the period from the user's notification up to 96 hours falling on working days;5) providing consultations, in particular by phone and e-mail, to the Ordering Party's employees with regard to the operation of the licensed software; 6) periodic archiving of data and security of the collected data; 7) providing access to all additional functionalities of the system developed during the term of the contract; 8) coming to the Ordering Party's headquarters to remove defects in the operation of the software if telephone consultations prove insufficient.3Data hosting and server administration referred to above includes:1) data hosting;2) administration of the Internet connection and its security;3) administration of the application server;4) administration of the database server;5) round-the-clock monitoring of the connection and servers.4 Essential rules for the performance of the contract:1) The Contractor undertakes to make working copies of the data collected in the ODPR and REKO software in order to secure and restore such data in the event of a breakdown in communication. The data should be secured in such a way that the Ordering Party has the possibility to restore data from the last 24 hours.2) Under the contract the Economic Operator will be obliged to carry out the works being the subject matter of the contract on time and with due diligence required of a professional, in accordance with applicable regulations and technical standards. In particular, the Economic Operator shall be obliged to execute the subject matter of the contract by professionally trained staff having the required knowledge, competences, experience and appropriate permits or authorizations, if required. 3) The Economic Operator undertakes to provide the services specified in the subject matter of the contract without interfering with the operation of the software. 4) The Economic Operator must not conclude any agreements or arrangements which would make it impossible to execute the contract, in particular agreements which would create a conflict of interest or which would make it impossible to properly represent the interests of the Awarding Entity.
