The subject of the order is Winter maintenance of sidewalks and bicycle paths along district roads within the administrative boundaries of the municipality of Pila - season 2023/2024.The subject of the contract are services related to winter maintenance of sidewalks and bicycle paths along district roads, the scope of which includes preventive measures, elimination of slipperiness and snow removal, using their own materials and their own equipment and transport, in particular:1) mechanical and manual clearing of snow from sidewalks and bicycle paths - according to the list - Appendix No. 3 to the SWZ,2) combating slipperiness on sidewalks and bicycle paths with the help of de-icing agents and chemicals (chemicals approved by the Employer, by prior arrangement) in accordance with the list - Annex 3 to the SWZ,3) removal of snow and ice, which is understood as the mechanical or manual removal of accumulated snow or ice from the surface of sidewalks or bicycle paths, loading, transportation and disposal.
(1) The subject of the contract is Winter maintenance of sidewalks and bicycle paths along district roads within the administrative boundaries of the municipality of Pila - season 2023/2024.2. The subject of the order are services related to winter maintenance of sidewalks and bicycle paths along district roads, the scope of which includes preventive measures, elimination of slipperiness and snow removal, using their own materials and their own equipment and transport, in particular:1) mechanical and manual clearing of snow from sidewalks and bicycle paths - according to the list - Appendix No. 3 to the SWZ,2) combating slipperiness on sidewalks and bicycle paths with the help of de-icing agents and chemicals (chemicals approved by the Employer, by prior arrangement) in accordance with the list - Appendix No. 3 to the SWZ,3) removal of snow and ice, which means mechanical or manual removal of accumulated snow or ice from the surface of sidewalks or bicycle paths, loading, transportation and disposal.3. The Ordering Party also provides for additional orders on areas marked in Appendix 3 to the SWZ (List of sidewalks and bicycle paths) as excluded areas. The time for execution of additional orders is up to 4 hours from the time of transfer of the order by the Ordering Party.4. Services included in the scope of the contract should be performed in accordance with applicable laws, including the requirements set forth in:1) the Regulation of the Minister of Environment of October 27, 2005 on the type and conditions of application of agents that can be used on public roads and streets and squares (Journal of Laws 2005 No. 230 item 1960). On public roads and streets, chemical agents should be used in a way that is least harmful to green areas and trees. Sprinkling of pavement with sand or chemical agents must be preceded by mechanical shovelling of snow;2) the Law of April 16, 2004 on Nature Protection (Journal of Laws 2023, item 1336). Those who use chemicals in a manner that significantly harms green areas and trees - shall be subject to punishment by arrest or fine.4. A detailed description of the subject of the contract is contained in Appendix No. 3 to the SWZ.5. The Contracting Authority specifies the requirements referred to in Article 95 of the PPL Act.1.) The Contracting Authority, pursuant to Article 95 of the PPL Act, requires employment by the Contractor or a subcontractor on the basis of an employment relationship of persons performing the following activities within the scope of the contract - driving a snow plow, a self-loading truck, operating a loader/backhoe loader.2) The Contracting Authority has the right to inspect the Contractor for compliance with the requirements specified in item. 1. At the request of the Contracting Authority, within the period specified by the Contracting Authority not shorter than 5 working days, the Contractor undertakes to submit for inspection a statement confirming that the employees referred to in paragraph 1 are employed under an employment contract;3) The method of verification of employment of these persons and the powers of the Contracting Authority to control compliance by the Contractor with the above requirements, as well as sanctions for failure to comply with these requirements are specified in Appendix No. 5 to the SWZ - Draft provisions of the contract.6The Contracting Authority intends to award contracts referred to in Article 214 (1) (7) of the PPL Act over a period of 3 years from the date of awarding the basic contract, with a value of up to 30% of the basic contract. The contract will consist in the repetition of services of the same type.
