Conclusion of non-exclusive discount agreements in accordance with Sections 130a para. 8/130c para. 1 SGB V for medicinal products with the active ingredient betahistine (N07CA01) within the period from March 1, 2024 to February 28, 2026 with the possibility of concluding a contract at any time (open house model). medicinal products according to the BfArM list pursuant to Section 35 para. 5a SGB V (pediatric medicinal products) are excluded in the open house procedure.
AOK Rheinland-Pfalz/Saarland - Die Gesundheitskasse offers all interested pharmaceutical companies discount agreements with the active substance betahistine (N07CA01) without a selection decision. The contracts are concluded within the framework of an "open house model". The contracts offered are not exclusive; contracts with all market participants (pharmaceutical companies) are desired by AOK Rheinland-Pfalz/Saarland - Die Gesundheitskasse. In the open house model, uniform conditions apply to all participants. Contract contents, conditions and access procedures are standardized - individual negotiations are not conducted. The maximum contract term is 24 months, the earliest contract start date is 01.03.2024. All contracts end no later than 24 months after the earliest contract start date, regardless of the date on which the contract was concluded. Membership or the conclusion of a contract can take place on the first of each month within the 24-month period. There is a right of termination six weeks to the end of each month in accordance with the provisions of the contract. AOK Rheinland-Pfalz/Saarland - Die Gesundheitskasse reserves the right to replace the non-exclusive open house discount contracts with exclusive discount contracts during the term of the contract as part of Europe-wide tendering procedures. When tendered, exclusive discount contracts come into force, the open house contracts will be terminated in accordance with the contractual provisions, i.e. the open house contracts will end automatically. Interested pharmaceutical companies can request the participation documents and the contract documents from the contact address stated under I.1). Contracts for the active substance betahistine (N07CA01) will be concluded for the first time with effect from 01.03.2024. Interested parties who wish to become contract partners on this date must submit the contract documents to AOK Rheinland-Pfalz/Saarland - Die Gesundheitskasse by January 31, 2024. The date of receipt by AOK Rheinland-Pfalz/Saarland - Die Gesundheitskasse is decisive. Note: The first contract in this procedure will be awarded at the earliest 10 calendar days after publication of this EU notice in the Official Journal. Subsequent contracts may be concluded on the first of each month during the twenty-four-month maximum term. For interested parties who wish to become contract partners on these subsequent dates, the receipt of the contract documents including the annexes must be submitted no later than the end of the month preceding the month in which the contract is to start (e.g. receipt 30.04. for contract start 01.06.). The exact deadlines for receipt will be announced with the contract documents. This publication does not constitute the award of a public contract within the meaning of the Public Procurement Coordination Directive 2014/24/EU of the European Parliament and of the Council or public procurement law. In order to ensure the greatest possible degree of transparency for the intended conclusion of contracts, the publication is made in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice is used. The resulting conceptual specifications, such as the procedure designation "open procedure", are solely due to the use of this publication form and the publication platform. This does not imply any further significance, in particular submission to public procurement regulations, unless they are mandatory for legal reasons.
