Description

(1) The subject matter of the order is the successive supply of medicinal products, described in detail in Appendix No. 2A to the SWZ (assortment and price form), which is an integral part thereof. (2) The terms and conditions for the performance of the order are also specified in the draft agreement in Chapter XX of the SWZ.

(2) In the description of the subject matter of the contract the Ordering Party has defined quality requirements relating to at least the main elements constituting the subject matter of the contract - he requires the supply of medicinal products with a precisely defined qualitative and quantitative composition - in connection with this fact he makes use of the possibility indicated in art.246 item 2 of the Public Procurement Law.3. The Ordering Party requires that the offered medicinal products are: a) admitted to marketing in Poland, in accordance with the provisions of the Act of September 6, 2001. Pharmaceutical Law (Journal of Laws No. 126, item 1381, as amended).b) listed in the current Announcement of the Minister of Health on the list of reimbursed drugs, foodstuffs for special nutritional use and medical devices in Part B (Drugs available under the drug program). The Ordering Party has defined in the description of the subject matter of the order quality requirements relating to at least the main elements constituting the subject matter of the order - it requires the supply of medicinal products with strictly defined qualitative and quantitative composition - in connection with this fact it uses the possibility indicated in art.246 item 2 of the Public Procurement Law.3 The Ordering Party requires that the offered medicinal products are authorized for marketing in Poland, in accordance with the provisions of the Act of September 6, 2001.
