The agreement can be concluded at any time and under the same conditions. Interested pharmaceutical companies can request the participation documents (discount agreement and the form mentioned under III.1.1) via the e-mail address mentioned under I.1). Agreements under this model will be concluded between 1.7.2019 and 31.8.2021. Interested parties must submit the fully completed and signed participation documents (self-declaration of non-existence of reasons for exclusion and discount agreement) for the first time by 28 June 2019, then by the 15th of each month to the office named under I.1). It depends on the access to the AOK PLUS. If the 15th of a month falls on a Saturday, Sunday or national public holiday, such day shall be replaced by the next working day. In case of later receipt (after 28.6.2019 or 15. of a month) the submitted participation documents will be considered on the 15th of the following month. The discount agreement becomes effective as soon as AOK PLUS has signed the discount agreement after receipt of the complete documents signed by the pharmaceutical entrepreneur. The first submission by 28.6.2019 will be signed by the 27th calendar week 2019, but not before 1.7.2019. Discount agreements submitted after 28.6.2019 will be signed by AOK PLUS until the end of the month in which the participation documents must be received by AOK PLUS. In terms of organisation, AOK PLUS needs an advance notice of approx. half a month in order to notify the discount agreement. The initial labelling of the discount drugs in the pharmacy software takes place from the second month following the deadline for receipt of the participation documents. This date may vary in the event of changes or new deadlines being set for deadline registrations in the nationwide AOK contract registration portal DatRabatt. A discount agreement will be concluded with all pharmaceutical companies that meet the conditions for participation and confirm this by signing the requested documents. The contract will end on 31.8.2021 at the latest, irrespective of the date of conclusion of the contract. AOK PLUS reserves the right to terminate the open-house procedure prematurely, in particular in the event of the conclusion of exclusive discount agreements. In this case, contracts already concluded shall terminate in accordance with the provisions of the contract. According to the experience of AOK PLUS, exclusive discount agreements generally come into force eight to twelve months after the publication of the corresponding tender notice in the Supplement to the Official Journal of the European Union. The future contractual partners in the open-house model are requested to inform themselves regularly about this in the Supplement to the Official Journal of the European Union. Note: This publication does not constitute the award of a public contract within the meaning of the Procurement Directive (2014/24/EU) or procurement law. In order to ensure the greatest possible degree of transparency for the intended conclusion of contracts, they are published in the Supplement to the Official Journal of the European Union. In the absence of an appropriate publication form, the contract notice shall be used. The resulting requirements ("mandatory fields"), such as the procedure designation "open procedure", "award criteria" and "conditions for the opening of tenders" are solely due to the use of this announcement form and the publication platform. This does not imply any further significance, in particular submission to procurement law regulations, unless they are mandatory for legal reasons.
