Description
UNDP's Mauritius office is looking for a legal expert to assess the present legislations and draft a comprehensive digital health legislation accordingly.
Context
Mauritius is planning for a national citizen-centred digital health solution. This innovation in digital health will likely bring significant legal, regulatory and policy challenges.
Currently, no legislation adequately addresses the distinct features of such health technologies and this requires the drafting of a comprehensive and modern digital health legislation.
The expert will be required to:
- review and assess the adequacy of the legal and institutional framework for digital health, not limited to the relevant provisions of the Data Protection Legislation, Cybersecurity and Cybercrime Act, Electronics Transactions Act, Information and Communication Technologies Act, Mauritius Emerging Technologies Council Act, as well as legislations relevant to the health sector in Mauritius
- provide a comparative analysis of digital health legislation in various countries where e-health is implemented in public hospitals and outline the salient features that can be implemented locally
- based on the above analysis, draft a policy paper on digital health based on the local context
- prepare the necessary legislation (including relevant regulations) on digital health and ensure that the new Digital Health Bill addresses future concerns of the health sector
