This Master Agreement shall apply to the conclusion and performance of employee leasing agreements between the Hiring Party and the Lending Party in one or more of the following service categories (job families). The selection of the service categories to be covered by this Agreement shall be made by the Lender. However, this is NOT such an open procedure - the announcement form had to be used for technical reasons, as there is no form suitable for approval procedures. gematik rather assumes that this admission procedure does not fall within the scope of application of the "Cartel Procurement Law" due to the lack of a selection decision and thus the non-discriminatory access possibility to the framework agreement.Prerequisites for the conclusion, respectively the later accession to the framework agreement, which will come into force for the first time on 01.10.2022, is the complete and timely submission of the following proofs/declarations/attachments to the contact person at gematik listed below:1. Application for admission to or accession to the Open House Framework Agreement RXÜ 5 - Miscellaneous Specialists II (form).2. proof of entry in the professional or commercial register (not older than 6 months at the time of application for admission or accession) in accordance with the legal provisions of the country in which the company is domiciled (as a non-certified copy) or, if applicable, declaration that no entries exist in the professional or commercial register in accordance with the relevant country's legal provisions (form). 3. signed self-declaration of the company on reliability (form).4. signed self-declaration that the company has fulfilled its obligations to pay taxes, duties or contributions to social security (form).5. Proof of the existence of a permit for the provision of employees to third parties for the performance of work in accordance with Section 1 (1) of the German Personnel Leasing Act (AÜG).6. Signed and company-stamped framework agreement "Open House Framework Agreement RXÜ 5 - Various Specialists II (2 original copies) without attachmentsThe above-mentioned documents must be submitted in writing (form). Adherence to this deadline is not mandatory, however, as later accessions usually take place seven days after gematik receives the application for admission or accession to the framework agreement.
