Description
The object of the Company of the Principal, a wholly owned subsidiary of the Federal Republic of Germany, is currently the operation of a system for the collection and control of truck tolls in Germany, the provision of technical and consulting services in connection with the control services of the Federal Office for Logistics and Mobility and services in connection with the European Electronic Toll Service.For the use of toll roads with toll vehicles, the toll debtor is obliged to pay a toll. The subject of this publication is the conclusion of acceptance contracts as part of a registration procedure. This is intended to ensure the cashless payment of tolls via acceptance agreements for fuel cards with issuers, at the latest as of 01.09.2024.
Any suitable fuel card issuer (hereinafter referred to as TC issuer) may conclude an acceptance contract with the contracting authority. In this context, the TC issuer is suitable if it meets the approval criteria specified by the principal (see section III). No further selection decision will be made, for example on the basis of price and/or performance and/or quality competition. The application for admission is possible at any time. The agreement regulates the acceptance of TK issuers' legitimation objects in the form of fuel cards, which enable payments and services in limited networks or with a limited range of vehicle-related products. In the Payment Services Supervision Act (Zahlungsdiensteaufsichtsgesetz, ZAG) and the associated information sheet, reference is made to the area exception for payment instruments in a limited range, which also includes fuel cards. This definition is applied here, although it should be noted that it is not the fulfillment of the range exception per se that is the criterion here. According to the current legal situation, such claims are in particular:- claims for reimbursement of expenses to which the Principal is entitled vis-à-vis customers pursuant to Sections 669, 670 of the German Civil Code (BGB), the amount of which corresponds to the toll payable by the customer to the Federal Office for Logistics and Mobility within the meaning of Section 4 Para. other claims under private law of the Principal against customers for services which the Principal offers to customers within the scope of the existing technical and operational possibilities (claims for so-called toll-related additional services), provided that the Customer is the holder or authorized user of a fuel card and this fuel card is used as a method of payment vis-à-vis the Principal for the settlement of the aforementioned claims. Should the scope of the principal's duties expand in the future, with the result that further receivables arise, these shall also be included in the above-mentioned list of receivables.In particular, the collection of receivables from the subsequent collection of tolls (§ 8 BFStrMG) and from fine proceedings are not the subject of the approval procedure.The TC issuer provides the possibility for customers to make payments of the above-mentioned receivables by means of fuel cards and guarantees that the payment of the above-mentioned receivables will be made by the TC issuer. This consists of a percentage base remuneration and a variable remuneration per billed kilometer. The conditions will be reviewed on a cyclical basis. Individual contract negotiations will not be conducted and no exclusivity will be guaranteed to individual TC issuers. The customer is not obliged to purchase a certain minimum quantity. Furthermore, the ordering party reserves the right to discontinue acceptance of this means of payment at any time. The ordering party points out that participation as a group of applicants is not permitted within the scope of this approval procedure.
