The subject of the open house procedure is the conclusion of non-exclusive agreements on the provision of care services in accordance with § 45 SGB XI in twelve (12) territorial lots distributed throughout Germany for the period 01.10.2022 to 30.09.2024 (plus extension option 2x12 months).The services in accordance with § 45 SGB XI include the provision of care courses, individual home training and transitional care. As already made clear, this is not one of those - the notice had to be used for technical reasons, as there is no form suitable for admission procedures.
DAK-Gesundheit assumes that this procedure does not fall within the scope of anti-trust procurement law due to the lack of a selection decision and thus the non-discriminatory access opportunity for all suitable companies. Irrespective of this, the contract will end automatically upon the entry into force of an exclusive contract for the provision of nursing courses, individual home training and transitional nursing care pursuant to Section 45 of the German Social Code, Book Eleven (SGB XI) as a result of a formal award procedure in accordance with the regulations of Part 4 of the ARC with one or more contract partners.
