The subject of this publication is the conclusion of agreements on contrast media with various active ingredients or combinations of active ingredients within the framework of a so-called "open-house model" to ensure the cost-effectiveness of the procurement of contrast media within the scope of the Hessian consultation requirement (SSB). Joining or contracting can be done at any time and under the same conditions. Individual contract negotiations are not carried out.The earliest contract start date is 01.12.2023.Based on this, the contract term is a maximum of 24 months. The contract ends on 30.11.2025 in each case regardless of the start of the contract. Should the AOK Hessen carry out a tender for exclusive contracts in the form of an open procedure for the active ingredients or combinations of active ingredients during the term of the contract, the contracts concluded in the context of this publication will be terminated in accordance with the contractual provisions.
All suitable and interested contractors (pharmaceutical companies including importers, manufacturers, wholesalers, pharmacies) will be offered the opportunity to conclude or join a rebate agreement for the above-mentioned active ingredients and combinations of active ingredients under uniform contract conditions and a uniform access procedure. Interested parties can request the participation documents and the contract from the contact address mentioned under I.1. after concluding a non-disclosure agreement with the AOK Hessen. A prerequisite for the conclusion of a contract is that the interested contractor submits the requested non-disclosure agreement and participation documents completely filled out and signed. A contract will be concluded with each interested party that meets the participation requirements. There is no exclusivity.This publication does not constitute the award of a public contract within the meaning of Directive 2014/24/EU or public procurement law. In order to ensure the greatest possible degree of transparency for the intended conclusion of contracts, the publication is made in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice is used. The resulting conceptual specifications, such as the procedure designation "open procedure" or the information under Item IV.2.2 "Conditions for the opening of bids", are solely due to the use of this announcement form and the publication platform. Accordingly, the information provided under clause IV2.7 is to be regarded as fictitious information. This does not imply any further significance, in particular submission to regulations under procurement law, unless they are mandatory for legal reasons.
