Description

The purpose of this announcement is to conclude drug discount agreements pursuant to Sections 130a (8) and 130c (1) of the German Social Code, Book V (SGB V) for the active ingredient(s) listed under II.1.1). This does not constitute the award of public contracts within the meaning of Directive 2014/24/EU or Sections 97 et seq. of the ARC. Any pharmaceutical entrepreneur pursuant to Section 4 (18) AMG may become a contracting party. According to the case law of the ECJ, such approval procedures are not necessarily subject to public procurement law, as no competition takes place due to the lack of a selection decision. The announcement serves as an invitation to conclude discount contracts with conditions that apply equally to all contracting parties and are not dispositive, including the determination of the discount. The contract is concluded by signing the contract documents and submitting the required declarations, which can be requested from the contact point named under I.3).
The earliest commencement of the contract is 01.05.2023, provided that the signed contract and the required declarations have been received by 04.04.2023 at the contact point named under I.3). The information in IV.2.2) refers to this. In the event of later receipt, the contract shall commence on the first day of the month following the month in which the signed contract and the required declarations or evidence are received by the contact point named in I.3), provided that receipt takes place by the fifth day of each month; otherwise, it shall commence on the first day of the month after next. The contracts shall end automatically, without the need for termination, as soon as contracts are concluded for the active substance(s) or the combination(s) of active substances within the framework of an award procedure. The contracts end on April 30, 2025.
