NOTICE OF INTENT TO AWARD SOLE SOURCE CONTRACT: Under the authority of FAR 6.302-1, it is the Government's intent to award a sole source Architect Engineer (AE) contract to Cannon Design/GKK Works, Designer of Record (DOR) for bidder inquiry evaluation services and construction phase services associated with the construction of the Veteran Affairs (VA) San Diego Spinal Cord Injury and Community Living Center facility, and parking structure for the Department of Veterans Affairs.
THIS IS NOT A REQUEST FOR PROPOSALS AND A SOLICITATION WILL NOT BE ISSUED.
This notice is not a formal solicitation and is for informational purposes only. No solicitation document is available and telephone requests for a copy of a solicitation will not be honored. However, interested vendors may submit a capability statement for the agency's consideration solely for the purpose of determining whether a competitive procurement should be conducted in the future for this requirement. Any response to this notice must show clear and convincing evidence that competition will be advantageous to the Government. Oral communications are not acceptable in response to this notice. No telephone calls are being accepted. All responses received within 30 days of this posting will be considered. If no affirmative written response is received, a sole source contract will be awarded without further notice. A determination by the Government not to compete this procurement action based on responses to this notice is solely at the Government's discretion.
The Government's acquisition strategy not to compete this proposed AE contract is based on the unique knowledge or capabilities of Cannon Design as the DOR and therefore the only firm able to meet the requirements of this procurement. Cannon Design performed the AE design of the VA San Diego Spinal Cord Injury and Community Living Center facility and parking structure and has essential knowledge pertaining to the design and engineering elements of this facility. The Government has determined that a sole source contract to Cannon Design will maintain continuity of services from the design phase through the construction phase by utilizing the firm most familiar with this project. Using the same Architect Engineer firm to provide bidder inquiry evaluation and construction phase services is advantageous and will mitigate duplication of AE efforts in evaluation and validation of the existing design thereby reducing time and cost. Engaging a new AE firm will require additional time and effort to familiarize, evaluate and validate Cannon's design for the purpose of responding to bidder inquiries and construction phase requirements. Soliciting an A-E contract as a competitive procurement will have a negative impact on the project schedule due to requirements of a multiphase source selection process. Also taken into consideration is the potential to have differing assumptions and assessments from another firm as well as for disputes and liability issues involved with multiple firms performing services separately that are inherently associated to each other and to the design and construction of one facility.
