Conclusion of a non-exclusive rebate contract according to § 130a para. 8 SGB V (German Social Code) for the drugs with the active ingredient Enoxaparin (ATC-Code: B01AB05) that can be prescribed and dispensed within the scope of consultation hours in Lower Saxony within the period from 01.12.2023 to 30.11.2025 with the possibility of concluding the contract at any time during the term ("open-house model").
ARGE Sprechstundenbedarfsbeschaffung GbR (ARGE-SSB) intends to conclude non-exclusive drug discount contracts for the active ingredient enoxaparin (ATC code: B01AB05) with as many market participants as possible (pharmaceutical entrepreneurs or communities of pharmaceutical entrepreneurs) in the so-called "open-house model".ARGE-SSB will not make a selection decision and will submit an identical contract offer to each interested pharmaceutical company. In the open-house model, uniform conditions apply to all participants. Contract contents, conditions and access procedures are uniform - individual negotiations are generally not conducted. The contract periods are a maximum of twenty-four months; the earliest contract start date is December 1, 2023. All contracts end no later than November 30, 2025, regardless of the date on which the respective contract is concluded. Within the twenty-four-month period, a member may join or conclude a contract on the first day of any month. There is a right of termination six weeks to the end of each month. Interested pharmaceutical companies can request the contract documents and the terms and conditions of the contract at the contact address stated under I.1).Contracts for the active ingredient enoxaparin (ATC code: B01AB05) will be concluded for the first time with effect from December 1, 2023. Interested parties wishing to become contract partners on this date must submit the contract documents to be submitted to the address specified in the contract documents by October 27, 2023. The date of receipt by ARGE-SSB is decisive. Later contract conclusions are possible during the twenty-four-month maximum term on the first of each month. From an organizational point of view, ARGE-SSB usually requires a lead time of 35 calendar days in order to be able to carry out the necessary work, e.g. to register the contract in the Lauer-Taxe®. The exact deadlines for receipt will be announced with the contract documents. This publication does not constitute the award of a public contract within the meaning of Directive(2014/24/EU) or public procurement law. In order to ensure the greatest possible degree of transparency for the intended contract conclusions, the publication is made in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice is used. The resulting conceptual specifications, such as the procedural designation "open procedure", are solely due to the use of this publication form and the publication platform. A further meaning, in particular a subjection to subcontracting regulations, as far as they are not obligatory for legal reasons, is not connected with it.
