Conclusion of a non-exclusive discount agreement in accordance with Section 130a (8) SGB V for medicinal products with the active substance permethrin (ATC code: P03AC04) within the period from 01.01.2024 to 31.12.2025 with the possibility of concluding a contract at any time during the term ("open-house model").
For the active ingredient permethrin (ATC code: P03AC04), AOK Niedersachsen. Die Gesundheitskasse offers discount contracts to all interested pharmaceutical companies without a selection decision for the period until exclusive contracts come into force following a formal award procedure in accordance with the regulations of Part 4 of the GWB. The contracts are concluded within the framework of an "open-house model" and act as a bridge between the start of generic competition (patent expiry) and the awarding of exclusive contracts. The contracts offered are not exclusive; contracts with all market participants (pharmaceutical companies) are desired by AOK Niedersachsen. In the open-house model, uniform conditions apply to all participants. Contract contents, conditions and access procedures are standardized - individual negotiations are generally not conducted. The contract terms are a maximum of twenty-four months, the earliest contract start date is 01.01.2024. All contracts end on 31.12.2025 at the latest, regardless of the date on which the respective contract is concluded. Membership or the conclusion of a contract can take place on the first of each month within the twenty-four-month period. There is a right of termination six weeks to the end of each month. The AOK Niedersachsen. Gesundheitskasse reserves the right to replace the non-exclusive open-house discount contracts with exclusive discount contracts during the term of the contract. With the entry into force of tendered, exclusive discount contracts, the open-house contracts are terminated in accordance with the contractual provisions, i.e. the open-house contracts end automatically. According to the experience of AOK Niedersachsen, exclusive discount contracts usually come into force six to eight months after the publication of the corresponding tender notice in the Supplement to the Official Journal of the European Union. Interested parties who wish to become contract partners by this date must submit the contract documents to the address stated in the contract documents by November 27, 2023. The date of receipt by AOK Niedersachsen is decisive. Contracts may be concluded at a later date on the first of each month during the twenty-four-month maximum term. Organizationally, a lead time of usually 35 calendar days on the part of the AOK is necessary to ensure the necessary work, e.g. the contract registration in the Lauer-Taxe®. The exact deadlines for receipt will be announced with the contract documents. This publication does not constitute the award of a public contract within the meaning of Directive (2014/24/EU) or public procurement law. In order to ensure the greatest possible degree of transparency for the intended contract conclusions, the publication is made in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice is used. The resulting conceptual specifications, such as the procedural designation "open procedure", are solely due to the use of this publication form and the publication platform.
