Description

1.
The client requires two new CT systems that can be operated for at least 10 years from acceptance in accordance with the current and then applicable legal regulations (hereinafter also referred to as "systems", "CTs" or "devices").
One of the systems is to be installed and used at the Friederikenstift site, the other system at the Henriettenstift site. Both systems are to be from the same manufacturer in order to minimize the familiarization period given the frequent staff rotations and fluctuations. The systems should offer state-of-the-art performance for all areas of medicine, particularly in the fields of neuroradiology, polytrauma diagnostics and cardio-diagnostics (system expected at the Henriettenstift site).
The CTs must be connectable via worklist server to the clinical information system Orbis from DEDALUS using a Dicom interface of the CTs.
The aim of the contract award is to put the CTs into productive use as quickly as possible, at the latest within 6 months of the contract being awarded. These serve as a replacement for 2 older CTs. Due to the background of the replacement procurement, it is of utmost importance to the client that the unavailability of the respective CTs due to the delivery, installation and commissioning of the CTs is as short as possible and that the time of installation is coordinated with and approved by the client. The contractor's many years of expertise in the delivery, installation and commissioning of CTs, particularly in the hospital sector and in relation to the ORBIS HIS, is therefore of particular importance to the client. In addition, based on the references provided, the contractor is familiar with the special protection requirements for sensitive data in the hospital sector and knows the processes relevant to the delivery and commissioning of new equipment.
The Contractor is also required to maintain special confidentiality to ensure IT security and data protection, see Annex 7 (Confidentiality) and Annex 8 (Data Processing Agreement).
The CTs shall be delivered and installed by the Contractor, integrated into the Client's IT system together with the Client (via DICOM interface to the existing worklist server of Dedalus) and put into operation together with the Contractor after the Client's employees have been trained.
At the same time, the contractor provides a fleet management system via the cloud, which can be used to manage the CTs and other devices from the manufacturer. For this purpose, the Contractor shall provide appropriate storage space, grant the Client the rights of use to this in accordance with the further provisions and maintain the management software, see also Annex 3 - Criteria catalog sub-appendix.

2.
The software for operating the CTs runs locally at the Client. All current and future operating companies and facilities\/operating sites of the client, cf. Annex 4, are also entitled to control the CTs and share the use of the computer programs, databases, etc. integrated in the devices, e.g. to carry out teleradiology, without incurring further usage fees.
With regard to all computer programs, databases and other protected works that are part of the delivered CTs, the Customer shall receive simple permanent rights of use ("Group License", see Annex 6), as well as with regard to any program updates and replacements within the scope of maintenance \/maintenance or care and service. These rights shall be transferred to the Client upon delivery of the respective CT. The Client hereby accepts the transfer of the rights of use.

3.
It is essential for the Client that maintenance, servicing, care and support for the devices is ensured (hereinafter referred to collectively as "Service").
